This is a draft for legal review.
1. Who we are
BacktoTrack Ltd operates BacktoTrack, a recruitment marketplace and employment-support platform.
2. What we do and do not do
We introduce candidates and employers, and provide tools to assess employment readiness and manage recruitment. We are not an employer, we are not an employment agency or employment business unless we say so in writing for a specific arrangement, and we do not guarantee anyone a job or anyone a hire.
We do not give legal, financial, immigration, housing or medical advice. Guidance on the platform — including guidance about criminal-record disclosure — is general information to help you prepare.
3. Your account
You must give accurate information, keep your password private, and not share your account. You must be 16 or over to create a candidate account. We may suspend or close an account that breaks these terms, is used fraudulently, or puts other users at risk.
4. If you are looking for work
Candidate accounts are free. You control what is visible. You are responsible for what you choose to tell an employer. You must not misrepresent your qualifications, right to work or experience.
5. If you are an employer or agency
You must advertise only genuine vacancies, describe them accurately, and comply with employment, equality and data-protection law. You must use candidate information only to recruit for the vacancy it relates to, keep it secure, and delete it when the retention period ends.
You must not request a criminal-record check that the role is not legally eligible for, ask a candidate to disclose information they are not legally required to disclose, or reject a candidate automatically because of a conviction. Where a record is lawfully relevant, you must carry out an individual assessment.
Subscription fees, quotas and billing terms are set out in your plan.
6. Prohibited use
No unlawful discrimination, harassment, fraudulent vacancies, fee-charging to candidates, scraping, automated access without permission, attempts to bypass access controls, or misuse of anyone's personal information.
7. Liability
We provide the platform with reasonable skill and care but we do not warrant uninterrupted availability. To the extent permitted by law we are not liable for indirect or consequential loss, for a hiring decision, or for the conduct of any user. Nothing here excludes liability that cannot lawfully be excluded.
8. Changes and governing law
We may change these terms and will tell you about material changes. These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except that if you live in Scotland or Northern Ireland you may bring proceedings in your own courts.
